By clicking the payment button and entering your credit card information, making a payment, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client”) agree to be provided with products, programs, or services by Workman Success Systems, LLC (“Company”), and you are entering into a legally binding agreement (“Agreement”) with the Company, subject to the following terms and conditions:

TERM & SCOPE.

The Term of this Agreement is twelve (12) months (the “Term”). Upon execution of this Agreement, and regardless which payment option is selected, Client hereby acknowledges that they are entering into a 12-month Agreement with Company.

The scope of services rendered by Company pursuant to this Agreement shall be solely limited to those contained within the REAL TEAMS Solution program (the “Program”) as delivered via the Company’s learning management system.

Client agrees that their success or failure with the Program is solely dependent upon Client’s engagement in the Program including their willingness to watch all the sessions, complete all the assignments, etc. Client is responsible for his/her own success and implementation of objectives met.

The REAL TEAMS Toolbox
12 pre-recorded IQ Sessions, which in addition to the 1-hour IQ session itself, includes pre-session videos, assignments, and all associated resources.
Email support from Company throughout the program.

REFUND POLICY & PAYMENT OPTIONS.

While this is a 12-month program, all content is available up-front, so there are no refunds.

There are two payment options available: Option 1: payment in full with one (1) upfront payment; or twelve (12) equal monthly installments.

In the event the monthly installments payment option is selected:

Client hereby grants Company permission to charge Client’s credit card immediately for the first monthly installment, and then for eleven (11) consecutive months thereafter;

In the event Client’s credit card is declined for any reason, Company has the right to immediately terminate access to the Program until such payment is paid, including disallowing access to tools, apps, materials, and sessions. In addition, a 2% interest fee will be charged for each day that payment is late for a maximum of 30 days. If the Client does not commence with payments within 30 days, the Company has the right to terminate the Agreement and demand payment in full from Client for all remaining installment payments due.

In the event the one-time upfront payment option is selected:

Client hereby grants Company permission to charge Client’s credit card immediately for the full 12-month Program fee.

Access to the Program will only be granted upon successful processing of Client’s credit card.

SATISFACTION GUARANTEE.

Company hereby grants Client the following satisfaction and money-back guarantee:

Company is committed to your success and backs up its desire to see you succeed with a 100% Satisfaction Guarantee.

When you complete the entire Program, including watching all 12 sessions, completing all assignments, including daily success habits for a minimum of 4 days per week, hitting a minimum of 61 qualifying points, and a minimum of one hour of prospecting per day, we guarantee you will realize a minimum 3X ROI (Return on Investment) as measured by your gross commission income increase due to the Program.

If, at the end of the Term, you have not realized that ROI, Company agrees to refund your entire payment for the Program. Note, you will be required to provide proof of performance of all assignments, including those described above, in order to qualify for a refund.

METHODOLOGY.  

Client understands Company has made no specific guarantees as to the outcome of the Program, except as described herein. Client further acknowledges that Client’s success is primarily dependent upon Client’s own implementation of the concepts presented.

PROFESSIONAL DISCLAIMER.  

By participating in this Program, Client hereby acknowledges Company is not a legal professional or the like and is not legally qualified, nor a substitute for, advice from qualified professionals. Client understands that any information provided should be considered as recommendations or suggestions. Client further acknowledges that Company does not warrant the accuracy of any information provided, and is not liable for the decisions or actions by Client as a result of any communicated advice.

INTELLECTUAL PROPERTY RIGHTS.  

In respect of the documents specifically created for the Client as part of this Agreement, Company maintains all of the copyright, other intellectual property rights and any other data or material used or subsisting in the material whether finished or unfinished. Nothing in this Agreement shall transfer ownership of or rights to any intellectual property of Company to Client, nor grant any right or license other than those stated in this Agreement.

RIGHT TO TERMINATE.  

Company has the right to terminate the Agreement at any time at its discretion and will provide Client with a refund for any pro-rata portion of the program paid for in advance.

GOOD FAITH. 

Each party represents and warrants to the other that such party has acted in good faith, and agrees to continue to so act, in the negotiation, execution, delivery, performance, and any termination of this Agreement.

DISCLAIMER OF WARRANTIES.  

The services provided by Company are not intended to guarantee, without satisfactory completion of the terms to qualify for the guarantee, success in real estate. Success is instead specifically dependent upon the prospecting efforts and the implementation of the various business strategies as directed by Company.

The real estate industry can be highly competitive and unpredictable, and results may vary based on factors such as market conditions, competition, and the individual strengths and weaknesses of each real estate professional.

LIMITATION OF LIABILITY.  

By using Company’s services and purchasing this Program, Client accepts any and all risks, foreseeable or unforeseeable, arising from such transaction. Client agrees that the Company will not be held liable for any damages of any kind resulting from or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Program. Client agrees that the use of this Program is at the user’s own risk.

DISPUTE RESOLUTION.  

If a dispute is not resolved first by good-faith negotiation between the parties to this Agreement, every controversy or dispute to this Agreement will be submitted to a mediator of Company’s choice. The mediation shall occur within ninety (90) days from the date of the initial mediation demand and shall take place in the State of Utah. The Parties shall cooperate in exchanging and expediting discovery as part of the mediation process and shall cooperate with each other to ensure that the mediation process is completed within the ninety (90) day period. Failure to reach an agreed-upon settlement will result in further legal action.

GOVERNING LAW.  

This Agreement is subject to and will be interpreted in accordance with the laws of the State of Utah and any disputes arising out of this agreement will be adjudicated in the State of Utah.

ENTIRE AGREEMENT.  

This Agreement contains the entire agreement between the parties and supersedes all prior agreements between the parties, whether written or oral.
