By clicking the payment button and entering your credit card information, making a payment, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client”) agree to be provided with products, programs, or services by Workman Success Systems, LLC (“Company”), and you are entering into a legally binding agreement (“Agreement”) with the Company, subject to the following terms and conditions: TERM & SCOPE. The Term of this Agreement is month-to-month, and recurs automatically until canceled. The scope of services rendered by Company pursuant to this Agreement shall be solely limited to those contained within the Workman Success Training Center (the “Training Center”) as delivered via the Company’s learning management system. The Training Center includes, at a minimum, the following courses: Buyer Agent Mastery (BAM) Seller Listing Agent Mastery (SLAM) Rising Agent Mastery Program (RAMP) Admin Mastery Program (AMP) Client agrees that their success or failure with the Training Center content is solely dependent upon Client’s engagement with the content. Client is responsible for his/her own success and implementation of the concepts presented. Client may contact Company at any time by clicking this link to notify Company to stop the automatic monthly payments. Upon such notification, Client will retain access to the Training Center for at least 30 days following the date of Client’s last monthly payment. REFUND POLICY & PAYMENT OPTIONS. This is a month-to-month program; there are no refunds. In the event any monthly credit card payment is declined, Client agrees to contact Company and remedy the situation within seven (7) days. In the event the payment issue is not resolved by then, Company reserves the right to immediately terminate access to the Training Center until such payment is successfully processed. METHODOLOGY. Client understands Company has made no specific guarantees as to the outcome of Client’s access to the Training Center. Client further acknowledges that Client’s success is primarily dependent upon Client’s own implementation of the concepts presented. PROFESSIONAL DISCLAIMER. By engaging with Company, Client hereby acknowledges Company is not a legal professional or the like and is not legally qualified, nor a substitute for, advice from qualified professionals. Client understands that any information provided should be considered as recommendations or suggestions. Client further acknowledges that Company does not warrant the accuracy of any information provided, and is not liable for the decisions or actions by Client as a result of any communicated advice. INTELLECTUAL PROPERTY RIGHTS. In respect of the documents specifically created for the Client as part of this Agreement, Company maintains all of the copyright, other intellectual property rights and any other data or material used or subsisting in the material whether finished or unfinished. Nothing in this Agreement shall transfer ownership of or rights to any intellectual property of Company to Client, nor grant any right or license other than those stated in this Agreement. RIGHT TO TERMINATE. Company has the right to terminate the Agreement at any time at its discretion and will provide Client with a refund for any pro-rata portion of access to the Training Center paid for in advance. GOOD FAITH. Each party represents and warrants to the other that such party has acted in good faith, and agrees to continue to so act, in the negotiation, execution, delivery, performance, and any termination of this Agreement. DISCLAIMER OF WARRANTIES. The services provided by Company are not intended to guarantee, without satisfactory completion of the terms to qualify for the guarantee, success in real estate. Success is instead specifically dependent upon the prospecting efforts and the implementation of the various business strategies as directed by Company. The real estate industry can be highly competitive and unpredictable, and results may vary based on factors such as market conditions, competition, and the individual strengths and weaknesses of each real estate professional. LIMITATION OF LIABILITY. By using Company’s services and purchasing access to the Training Center, Client accepts any and all risks, foreseeable or unforeseeable, arising from such transaction. Client agrees that the Company will not be held liable for any damages of any kind resulting from or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Training Center. Client agrees that the use of the Training Center is at the user’s own risk. DISPUTE RESOLUTION. If a dispute is not resolved first by good-faith negotiation between the parties to this Agreement, every controversy or dispute to this Agreement will be submitted to a mediator of Company’s choice. The mediation shall occur within ninety (90) days from the date of the initial mediation demand and shall take place in the State of Utah. The Parties shall cooperate in exchanging and expediting discovery as part of the mediation process and shall cooperate with each other to ensure that the mediation process is completed within the ninety (90) day period. Failure to reach an agreed-upon settlement will result in further legal action. GOVERNING LAW. This Agreement is subject to and will be interpreted in accordance with the laws of the State of Utah and any disputes arising out of this agreement will be adjudicated in the State of Utah. ENTIRE AGREEMENT. This Agreement contains the entire agreement between the parties and supersedes all prior agreements between the parties, whether written or oral.
